Article III. DISTRICTS AND BOUNDARIES

In order to classify, regulate and restrict the location of businesses, trades, industries, residences, and other land uses and the location of buildings designed for specified uses; to regulate and limit the height and bulk of buildings hereafter erected, reconstructed, or altered; to regulate and limit the intensity of the use of lot areas, and to regulate and determine the area of yards, courts, and other open spaces within and surrounding such buildings, Olive Branch, Mississippi, is hereby divided into 18 districts. The use, height, and area regulations are uniform in each district, and said districts shall be known as:

A Agricultural district

AR Agricultural-residential district

R-1 Single-family residential district

R-2 Single-family residential district

R-3 Planned residential district

R-4 Multiple-family residential district

O Office district

C-l Neighborhood commercial district

C-2 Highway commercial district

C-3 General commercial district

C-4 Planned commercial district

C-5 Old Towne District

M-1 Light industrial district

M-2 Heavy industrial district

M-3 Planned industrial district (PID)

PUD Planned unit development district

F Flood control district

AHR Airport height use regulation district

The boundaries of these districts are indicated upon the zoning district maps of Olive Branch, Mississippi, which maps are made a part of this ordinance. The said zoning district maps of Olive Branch, Mississippi, and all the notations, references, and other matters shown thereon shall be as much a part of this ordinance as if the notations, references, and other matters set forth by said zoning district maps were all fully described herein, which zoning district maps are properly attested and are on file with the Chancery Clerk of DeSoto County, Mississippi.

All territory which may hereafter become apart of the City of Olive Branch by revision of the corporate boundaries shall remain in its existing classification until such time as such classification may be changed by an amendment to this zoning ordinance as provided by law.

Where uncertainty exists with respect to the boundaries of the various districts, as shown on the zoning district maps accompanying and made a part of this ordinance, the following rules shall apply:

a.

Where a boundary line is given a position within a street, road, or alley, it shall be deemed to be in the center of the street, road, or alley; and if the actual location of such street, road, or alley varies from the location as shown on the zoning district maps, then the actual location shall control.

b.

Where a boundary line is shown as approximately following municipal, county, or state boundaries, it shall be construed to follow such boundaries.

c.

Where a boundary line is indicated as approximately following the centerline of streams, rivers, canals, lakes, or other bodies of water, it shall be construed to follow such centerline.

d.

Where a boundary line is shown as being located a specific distance from a street or road line or other physical feature, this distance shall control.

e.

Where a boundary line is shown adjoining or coincident with a railroad, it shall be deemed to be in the center of the railroad right-of-way and distances measured from a railroad shall be measured from the center of the designated mainline track.

f.

In unsubdivided areas where district boundaries as shown on the zoning district maps do not coincide or approximately coincide with street lines, alley lines, or lot lines, and no dimensions are shown, the location of such district boundary lines shall be determined by the use of the scale appearing on the zoning district maps.
