§ 5-41. Hours of sale or consumption.

  • No person, partnership, corporation, other entity, nor any agent or employee thereof, operating a public or private commercial establishment shall permit the sale and/or consumption of alcoholic beverages on the premises of such establishment between the hours of 1:00 a.m. and 7:00 a.m., Monday through Sunday, seven days per week. [Note: per the October 18, 2013 Order of the Department of Revenue, the legal hours for the retail sale of liquor (excluding beer and light wine as regulated herein) in the City of Olive Branch for holders of on-premises retailer's permits is designated as the hours of 7:00 a.m. to 1:00 a.m., Monday through Sunday, seven days per week. The Department's Order of October 18, 2013 had no effect on the hours or days during which liquor may be sold by holders of package permits, said hours and days being set by statute and applicable ABC regulations.] The Department's extension of liquor hours to 1:00 a.m. resulted in the hours for beer sales being extended to 1:00 a.m. pursuant to MCA § 67-3-53.
