§ 26-3. Municipal fire protection district.

  • (a)

    That a municipal fire protection district hereafter known as the Olive Branch Municipal Fire Protection District be, and the same is hereby created and established pursuant to the authority granted by MCA 1972, § 21-25-21.

    (b)

    That the boundaries of said municipal fire protection district are more particularly set out in the exhibit attached as Exhibit "A" [hereinbelow:]

    Descriptions of a 5104.68 acre tract of land being situated in Olive Branch, Desoto County, Mississippi, said 5104.68 acre tract being the Olive Branch Municipal Fire Protection District and being more particularly described as follows:

    Beginning at the northwest corner of section 11, township-2-south, range-7-west, Desoto County, Mississippi, said northwest corner being at the intersection of Malone Road and Church Road;

    Thence N-89d46'24"-E along church road and the north line of said section 11, a distance of 5270.87' to a point at the northeast corner of said section 11, said northeast corner being at the intersection of Church Road and Pleasant Hill Road;

    Thence S-00d09'41"-W along Pleasant Hill Road and the east line of said section 11, a distance of 1230.91' to a point;

    Thence continuing along Pleasant Hill Road the following courses: S-10d18'22"-E 155.28', S-28d54'31"-E 265.76', S-48d18'24"-E 553.36', S-66d17'30"-E 1588.96', S-87d13'47"-E 646.59' to a point at the center of section 12, township-2-south, range-7-west said point being in West Sandidge Road;

    Thence N-00d04'29"-W along the west line of the northeast quarter of said section 12;

    And along West Sandidge Road 2663.20' to a point on the north line of said section 12, said point being at the intersection of West Sandidge Road and Church road;

    Thence N-89d35'29"-E along Church Road and along the north line of the northeast quarter of said section 12 and along the north line of section 7, township-2-south, range-6-west 8031.45' to a point at the northeast corner of said section 7, and being at the intersection of Church Road and Craft Road;

    Thence S-00d28'05"-E along Craft Road and along the east line of section 7 and 18, township-2-south, range-6-west 10627.09' to a point at the southeast corner of said section 18;

    Thence S-89d44'40"-W along the south line of said section 18 a distance of 2333.35' to a point in Camp Creek;

    Thence S-07d13'30"-W along said creek 10601.54' to a point on the south line of section 30, township-2-south, range-6-west;

    Thence S-89d03'12"-W along the south line of said section 30 and along the south line of section 25, township-2-south, range-7-west 4413.80' to a point at the southwest corner of the southeast quarter of said section 25;

    Thence N-00d18'10"-W along the west line of the east half of said section 25 a distance of 3941.03' to a point;

    Thence N-04d49'36"-W leaving said west line 660.33' to a point;

    Thence N-10d05'35"-W 673.61' to a point on the north line of said section 25;

    Thence N-88d23'07"-E along the north line of said section 25 a distance of 246.63' to a point, said point being at the southwest corner of the southeast quarter of section 24, township-2-south, range-7-west;

    Thence N-01d38'59"-W along the west line of the southeast quarter of said section 24 a distance of 1326.93' to a point;

    Thence northwardly the following courses: N-66d28'03"-E 939.22', N-68d56'25"-W 1294.82', N-48d24'04"-W 1903.70', N-25d52'46"-W 2076.28' to a point at the southeast corner of section 14, township-2-south, range-7-west;

    Thence N-89d55'29"-W along the south line of said section 14 a distance of 5288.20' to a point at the southwest corner of said section 14, said point also being in Malone Road;

    Thence N-00d06'47"-W along the west line of said section 14 and along the west line of section 11, township-2-south, range-7-west being along Malone Road 10565.99' to the point of beginning containing 5104.68 acres more or less.

    (c)

    That the Mayor and Board of Aldermen, as the directors of such municipal fire protection district, do hereby authorize the Mayor, City Clerk, and City Attorney to take such actions as are necessary to accomplish the creation of the district and the assumption of the assets and service area of the Summershill Fire Protection District.
