§ 18-106. Definitions.

  • For the purpose of this article the following word shall have the meanings designated herein:

    Commercial zone means those areas of the city designated in zoning districts, as presently defined by the zoning ordinance presently in effect for the city, the primary purpose of which is to permit the development of commercial and industrial uses. The "commercial zone," as used in this article shall include those properties designated within the "O," "C-1," "C-2," "C-3," "C-4," and "C-5" zoning districts, as well as the "M-1," "M-2," and M-3" zoning districts.

    Garage sales shall mean and include all sales entitled "garage sale," "lawn sale," "attic sale," "rummage sale," "flea market sale," "white elephant sale," or other casual sale of tangible personal property which is advertised in any fashion by any means whereby the public at large is or can be made aware of said sale.

    Goods shall mean and include any goods, warehouse merchandise, or other tangible, personal property capable of being the object of a sale as regulated hereunder.

    Improved property shall mean and include real property upon which a principal building and its appurtenant facilities have been constructed. Within the residential zone, this shall constitute the construction and occupation of a residential structure, with its appurtenant driveway and parking. Within the commercial zone, this shall constitute the construction and occupation of a commercial or industrial structure, as applicable under the relevant zoning district, with its appurtenant driveway(s) and paved parking area(s).

    Merchant shall be defined as any person having a fixed place of business in a commercial zoning district within the corporate limits of the city wherein goods are regularly sold on a retail or wholesale basis.

    Person shall mean and include a firm, group, organization, association, partnership, trust, company, or corporation, and any other entities, as well as an individual.

    Residential zone means those areas of the city designated in zoning districts, as presently defined by the zoning ordinance presently in effect for the city, the primary purpose of which is to permit the development of residential uses. The "residential zone," as used in this article shall include those properties designated within the "AR," "R-1," "R-2," "R-3," and "R-4" zoning districts.

    Vacant property shall mean and include real property, which has not been improved through the construction of a principal building upon the subject property.
