Article XIII. REPEAL OF PRIOR ORDINANCE, EFFECTIVE DATE


The subdivision regulations adopted April 7, 1970, by the City of Olive Branch, Mississippi, recorded in minute book 8, pages 77 through 138, and all amendments thereof, are repealed on the effective date of this ordinance. However, all applications and matters which have commenced under the April 7, 1970, regulations shall be completed with decisions rendered under the requirements set forth in those regulations without the necessity of a new application therefor.

If any part of this ordinance, section or provision are [is] found to be unconstitutionally invalid, the remaining part of those sections and provisions shall be valid, it being hereby declared that all constitutional and valid provisions hereof shall be enacted after the exclusion of any section or provision which might be found unconstitutional or invalid.

This ordinance shall take effect from and after April 1, 1983.

Any and all ordinances or parts of ordinances in conflict herewith, or any part hereof, are hereby expressly repealed.

The foregoing ordinance, having been reduced to writing, read and considered, section by section, provision by provision, and as a whole, the same was duly introduced and a motion was made for the adoption thereof by Alderman H. Gene Phillips, a second was offered by Scott B. Phillips and a vote was taken thereon with the following results.

Those present and voting in favor of the adoption of each and all of the sections and provisions of the foregoing ordinance, and the ordinance as a whole, are:

Present and voting Aye: Perry Bowlan, T. D. Doddridge, G. P. Gillespie, H. Gene Phillips and Scott B. Phillips.

Present and voting Nay: None.

Absent: None

The foregoing ordinance is passed, adopted and approved this the 1st day of March, 1983.
